IMPORTANT: AI Vet is NOT a Substitute for Professional Veterinary Care
• AI Vet provides informational guidance only and does not constitute medical advice, diagnosis, or treatment
• Our AI system is designed to assist with preliminary assessment, not replace licensed veterinarians
• Always consult a licensed veterinarian for proper diagnosis and treatment
• In case of emergency, contact your veterinarian or emergency clinic immediately
• We are not responsible for any decisions made based on AI-generated recommendations
• AI Vet does not diagnose, treat, cure, or prevent any disease or medical condition

3. User Accounts
Account Creation
• You must be at least 18 years old to create an account
• You must provide accurate, current, and complete information
• You are responsible for maintaining the confidentiality of your password
• You are responsible for all activities that occur under your account
• One account per person - do not share accounts
Account Security
• Notify us immediately of any unauthorized access or security breach
• We are not liable for losses resulting from unauthorized account use
• We reserve the right to suspend or terminate accounts that violate these terms
• Plus Plan: Unlimited consultations, $12.99/month
• Family Plan: Plus features + up to 3 pets, $18.99/month
• Hero Plan: Premium features + support charity, $24.99/month
Billing Terms
• Subscriptions are billed monthly or annually depending on your selection
• Payment is processed through Stripe (we never store full credit card details)
• Subscriptions auto-renew unless canceled before the next billing date
• Price changes will be communicated 30 days in advance
• Annual subscriptions receive 25% discount
Free Trial
• New users receive a 3-day free trial of Premium features
• After trial, you'll be charged unless you cancel
• One trial per user/household
• We reserve the right to modify or discontinue trials
Cancellation & Refunds
• Cancel anytime from your account settings
• Cancellation takes effect at the end of the current billing period
• No refunds for partial months or unused portions
• 7-Day Money-Back Guarantee: Full refund if canceled within 7 days of first payment
• Refunds processed within 5-10 business days
5. Prohibited Uses
You agree NOT to:
• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction

7. Liability Limitations

AI Vet is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to:
• Accuracy, reliability, or completeness of information
• Uninterrupted or error-free operation
• Fitness for a particular purpose
• Non-infringement of third-party rights
LIMITATION OF LIABILITY
To the maximum extent permitted by law, AI Vet shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
• Loss of profits, data, or use
• Veterinary expenses or treatment costs
• Pet injury, illness, or death
• Emotional distress
Our total liability shall not exceed the amount you paid us in the last 12 months, or $100, whichever is greater.
8. No Veterinarian-Client-Patient Relationship
NO VCPR IS ESTABLISHED
Use of Pawsitive Health AI does not establish a veterinarian-client-patient relationship (VCPR). Our AI system is not a licensed veterinarian and cannot:
• Examine your pet physically
• Prescribe medication or treatment plans
• Provide definitive medical diagnoses
• Replace the judgment of a licensed veterinary professional
9. AI Accuracy Disclaimer
Our AI system provides informational guidance based on patterns and training data. We make no guarantees about the accuracy, completeness, or reliability of AI-generated outputs. AI responses may be:
• Incomplete, outdated, or incorrect
• Not applicable to your pet's specific situation
• Subject to limitations in image analysis quality
• Unable to detect conditions requiring physical examination
Always verify AI suggestions with a licensed veterinarian before taking action.
10. Service Availability
While we strive for maximum uptime, we do not guarantee 24/7 uninterrupted service. The Service may be temporarily unavailable due to:
• Scheduled maintenance and updates
• Unexpected technical issues or outages
• Third-party service disruptions (AI providers, hosting, payment processing)
• Force majeure events
We are not liable for any losses resulting from service unavailability.
11. Data Ownership
• Your Data: You retain full ownership of all personal data, pet records, photos, and content you upload to the Service.
• License to Process: By using the Service, you grant us a non-exclusive, worldwide license to process, store, and analyze your data solely for the purpose of providing and improving the Service.
• Anonymized Data: We may use anonymized, aggregated data (with all personal identifiers removed) for AI model training, research, and analytics.
• Data Export: You may request a full export of your data at any time through Account Settings.
• Data Deletion: Upon account deletion, your data will be removed within 90 days, except billing records retained for 7 years for tax/legal compliance.
12. Dispute Resolution & Arbitration
BINDING ARBITRATION
Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration, rather than in court, except that either party may seek injunctive or equitable relief in any court of competent jurisdiction.
• Arbitration shall be conducted under the rules of the American Arbitration Association (AAA)
• The arbitration shall take place in the State of Delaware, United States
• The arbitrator's decision shall be final and binding
• Class action lawsuits and class-wide arbitration are not permitted
• You agree to waive any right to a jury trial
You may opt out of this arbitration clause by sending written notice within 30 days of account creation to legal@pawsitivehealth.ai.
13. Indemnification
You agree to indemnify, defend, and hold harmless AI Vet, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:
• Your use or misuse of the Service
• Violation of these Terms
• Violation of any third-party rights
• Your content or data
9. Termination
By You
• Cancel your account anytime from account settings
• Access continues until end of current billing period
• All data will be deleted 30 days after cancellation
By Us
• We may suspend or terminate accounts that violate these Terms
• We may discontinue the Service with 30 days notice
• No refunds for terminations due to Terms violations
10. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. We will notify you of significant changes via:
• Email to your registered address
• In-app notification
• Updating the "Last Updated" date
Continued use after changes constitutes acceptance of the modified Terms.
11. Governing Law
